Just two days after the Daily Nexus received a subpoena from the Santa Barbara County Public Defender’s Office, the order to appear in court was rescinded.
Yesterday afternoon, Daily Nexus Editor in Chief Nick Dürnhöfer received pro bono representation from Davis Wright Tremaine LLP Associate Robyn Aronson. Following a discussion with Deputy Public Defender Kathy Schwinghammer, Aronson convinced the attorney to drop the subpoena.
Schwinghammer had attempted to obtain the Nexus’ unpublished photos from the Feb. 12 anti-war protest at UCSB. Aronson argued that the unpublished photos were protected by reporter privileges and that the subpoena was served too late. Schwinghammer then agreed to drop the subpoena for the unpublished photos.
Dignity
It would be ungracious to point our fingers and laugh, to rock back and forth on our heels and saying, "Neener neener neener," to quote old Monty Python bits about farting in somebody’s general direction or to just stand outside the Public Defender’s office photographing things and taking notes for hours on end and then refusing to publish them.
Yup. Ungracious.
